Probate is a judicial process by which legal title to the decedent’s assets are transferred to beneficiaries. The probate process includes, but is not limited to, determination of the decedent’s assets, the maintenance and support of the surviving spouse and minor children, the determination of potential creditors, the preparation of the appropriate tax returns, an accounting of all transactions conducted by the personal representative and the distribution of the estate’s assets to the beneficiaries.
